Court ‘no’ To Adjourn Kedar’s Bail Plea, Order Likely Today | – Times of India

Nagpur: The district and sessions court on Wednesday pushed back the ruling on bail application of Sunil Kedar, disqualified MLA from Saoner and one of the convicts in NDCCB bank scam, by one more day. The judge while turning down the prosecution’s application to adjourn the bail plea till January 1, closed the matter for order on Thursday. Similar decision was taken on the bail pleas filed by five other convicts in the case.
In its application for the grant of adjournment, the prosecution said the special public prosecutor who had appeared online in the matter on the first day wanted to file a detailed reply to the arguments of the appellant’s counsels and file some relevant citations to support his contention.As the matter is of serous nature and a huge amount is involved, no prejudice will be caused if the court grants time for filing the reply, said the plea.
Apart from bail, Kedar’s counsel has also sought a stay on his conviction, as it can lead to reversal of his disqualification as MLA.
The prosecution separately put up its plea for adjournment after arguments by each of the counsels of the six convicts.
Meanwhile, Kedar is still admitted to the government medical college and hospital (GMCH) here. Other five convicts are in jail.
Doctors said Kedar’s health parameters have improved. A five member committee which include a cardiologist, pulmonologist, neurologist, and a physician has been formed to monitor his health.
Kedar has spent five days in the ICU of GMCH. His creatine level has improved and the throat infection has also eased, said doctors.
On Tuesday, his serum creatinine levels were high. This is an indicator of kidney health. Kedar had complained of chest pain and breathlessness but his angiography couldn’t be done due to high creatinine level.
Now, since the levels are under control, Kedar underwent angiography on Wednesday evening. However, doctors have not divulged the results so far. No decision has been taken on his discharge, and the final word will come from the five-member team.

After the order was pronounced, Kedar’s counsel Deven Chauhan rushed to the sessions court with an appeal. Judge RS Patil (Bhonsale) asked for the operative order. Chauhan approached the principal district judge (acting) MV Deshpande, who also insisted on the operative part of the order. As the order was not received, both judges went home. The case will be heard on December 26 after the court closure for three days. Chauhan plans to apply for suspension of sentence and MLAs bail on Tuesday morning.

Kedar’s supporters highlighted his influence in rural areas and contribution to Congress’ recent electoral success.

The conviction was made by CJM Jyoti Pekhle-Purkar on December 22, 2023. Kedar was sentenced to five years of rigorous imprisonment and fined Rs 12.5 lakh. His disqualification was cited under Article 191 (1) (e) of the Constitution of India. Kedar’s lawyer plans to challenge the judgment in the sessions court.
