Lucknow: The Lucknow bench of the Allahabad high court has stayed the demolition of the flats of certain petitioners in FI Tower constructed by a close aide of Mukhtar Ansari.
The court has directed the state government, LDA and flat owners to maintain the status quo.
The court also directed the state government and LDA to file a counter-affidavit in the matter within four weeks while it granted two weeks to the petitioners to file rejoinder in the cases.
The matter has been listed for the next hearing in six weeks.
A bench of Justice Abdul Moin passed the order on eight writ petitions filed by different owners, namely, Arif Siddiqui, Mohammed Tauqeer Siddiqui, Sahiba Karim, Afreen Khan, Mohammed Ahmad Khan, Amna Ansari, Sufia Bano and Abha Nagar.
The petitioners had pleaded before the court that proper notice was not served to them under section 27 of the UP Urban Planning and Development Act and that “the government and LDA were acting in utter haste and as such that the demolition action was mala fide”.
Hearing the matter, the bench found that the notices were not issued to the petitioners as per rules and that the action of the government was in haste and as such, as of now, interference of the court was necessary.
In a crackdown on illegal construction linked to mafia don-turned-politician Mukhtar Ansari, the LDA on December 24 had sealed the New FI Hospital owned by Siraj Ahmed, a close aide of Ansari. The LDA also initiated demolition of illegal structures in the parking area of the FI Tower, another property owned by Ahmed.
