Puja In Gyanvapi: Alld Hc To Take Up Aimc Petition Today | Allahabad News – Times of India

Prayagraj: The Allahabad high court will continue to hear on Wednesday a petition moved by the management committee of Gyanvapi mosque challenging the Varanasi District Court’s Jan 31 order, which allowed Hindus to perform puja in the southern cellar (Vyas Tehkhana) of the Gyanvapi mosque, in Varanasi.
Justice Rohit Ranjan Agarwal passed the order on a petition filed by Anjuman Intezamia Masajid Committee (AIMC), which manages the Gyanvapi mosque.
Earlier, the AIM had challenged the Jan 31 order and sought its stay during the pendency of the matter. AIM committee has now moved another petition challenging the Jan 17 order passed by district judge Varanasi by which it had appointed Varanasi DM as receiver of the property and he took possession on Jan 24. On Tuesday, the court in its order passed in another petition, directed to connect this petition and put up as fresh along with previous appeal at 10am on Feb 7.
However, during the course of hearing, the court orally directed the parties to the suit concerning the Gyanvapi mosque-Vyas cellar/tehkhana dispute to avoid making public statements or speaking to media about the case as long as the matter was sub-judice.
Appearing on behalf of Muslim side, senior advocate SFA Naqvi submitted that by order dated 31 Jan, the district judge, Varanasi had given final relief sought in the suit at the initial stage, which cannot be permitted. He further submitted before the court that the order was passed in a hurried manner and on the day of retirement of the judge concern.
On the other hand, on behalf of the Hindu side, Vishnu Shankar Jain submitted that an application for appointment of receiver as well as for offering rituals to deities was allowed by the court. On Jan 17, the order for appoinment receiver was passed and second part of prayer for puja was left open for which a mention was made on Jan 30, and court fixed next day for hearing and on Jan 31, order for offering puja was passed.
On the last hearing, on Feb 2, UP advocate general Ajay Kumar Mishra had given undertaking to the court that Varanasi’s administration would maintain law and order in pursuance of district judge’s order dated Jan 31.
Hindu side advocate Vishnu Shankar Jain had raised a preliminary objection regarding maintainability of appeal on the ground that the basic order dated Jan 17 for appointment of receiver had not been challenged.
In reply, senior advocate SFA Naqvi, who appeared for AIMC, submitted that he would be filing application for amending the appeal and laying challenge to the order dated Jan 17, passed by district judge, Varanasi.
