Patna HC Stays Vigilance Court Order Against BJP MP Janardan Singh Sigriwal | Patna News – Times of India

Patna: The Patna high court stayed a criminal proceeding against BJP parliamentarian Janardan Singh Sigriwal by staying an order of cognizance taken by the special vigilance court at Muzaffarpur.
A single bench of Justice Satyavrat Verma, while hearing the criminal miscellaneous petition of Sigriwal filed for quashing of the said case, passed this order on Tuesday.
A vigilance case (103/2016) was instituted against the BJP leader on October 7, 2016 under various sections of IPC and Prevention of Corruption Act 1988.
The FIR contained accusations against Sigriwal that he misappropriated public funds, committed cheating, forgery and taking illegal gratification while functioning as secretary of the managing committee of Dr T N Singh Degree College, which is an affiliated unit of Jai Prakash University, Chhapra.
The vigilance agency found the accusations against Sigriwal as true and sent the case for trial to the special court, which took cognizance of the offences allegedly committed by the BJP leader, on July 4, 2022.
Sigriwal’s counsel Satya Darshi Sanjay submitted that the cognizance order has been taken in a mechanical manner without appreciating the fact that there is no evidence available with the investigating agency. Hence, the accusation could hardly stand against his client. His client should not be harassed unnecessarily through “a forced trial” as the prosecuting agency has no prima facie evidence to support the allegations made against Sigriwal, Sanjay added.
Justice Verma also directed the vigilance bureau to furnish the materials available with them on the basis of which they sent the petitioner to court for facing trial.
