Nagpur: Construction of the 2.8km Y-flyover from Kadbi Chowk has been challenged before the Nagpur bench of Bombay high court. A portion of the flyover is being constructed from Pahelwanshah Dargah to Gupta Atta Chakki in Mominpura, with one arm of the railway overbridge connecting to Mominpura-Timki while the other lands near Santra Market.
Mohammad Firju Rahman, president of Mominpura Jama Masjid, has filed a public interest litigation demanding that the construction of this bridge be stopped. Accoding to the petitioner, this flyover has no administrative approval.
As per Rahman, the position of the flyover at the said place is illegal, besides there being no need for it.
Already, the two arms of Itarsi RoB are left hanging because of challenge to the approved design.
The Pachpaoli to Pahelwanshah Dargah Mominpura flyover has administrative approval, the petition states.
A bench of justices Nitin Sambre and Abhay Mantri issued notices to the state public works department, Central Railway secretary, central road transport department principal secretary, Maharashtra Railway Infrastructure Development Corporation, municipal commissioner, divisional commissioner, collector and police commissioner.
The court asked the responents to submit reply within six weeks. Advocates Sasibhushan Vahne and Yash Sawaitul represented the petitioner. Advocates Nandesh Deshpande and Deepak Thackeray argued for the state.
