Consumer Activists Allege Police Inaction in Executing Warrants Issued by Consumer Commission | – Times of India

Coimbatore: Consumer activists said police were not extending support to the district consumer redressal commission to execute warrants against the firms and individuals for not fulfilling its orders. They said 36 warrants and 140 execution applications were pending with the district consumer redressal commission.
As per the consumer protection act, Kathirmathiyon, secretary, Coimbatore Consumer Cause, said, the consumer commissions had to find a solution to the complaints in three months. “However, it takes more than a year to get a resolution in a case nowadays. In most of the cases, orders issued by the commission are not followed by the firms or individuals.”
If the opposite party does not obey the order passed by the consumer forum in a reasonable time and has not filed any appeal against the order, he said, the complainant could file a petition to execute the order of the consumer forum under Section 72 of the Consumer Protection Act, 2019. “Execution of a consumer court order is more difficult than obtaining an order.”
To execute the commission’s order, Kathirmathiyon said, the complainant had to file an execution petition before the commission after the one-month time given to the opposite parties to comply with the order.
“To execute the order, we send summons through police, who often keep the execution petitions and warrants pending. So, our orders are not getting fulfilled on time,” an official with the consumer commission said.
When contacted, district superintendent of police V Badrinarayanan said most of the stations were complying with court orders. “If there is any specific complaint, we will definitely take action. We have executed many orders of the commission.”
