Jayakumar moves HC against closure of complaint by SHRC | News Article | Chennai News – Times of India

Chennai: Former AIADMK minister D Jayakumar has moved Madras high court against an order passed by State Human Rights Commission (SHRC) closing his complaint against Chennai police for alleged human rights violations during his arrest in connection with a case registered for causing disruption during the 2022 local body election.
Admitting the plea on Monday, a division bench of Justice S S Sundar and Justice N Senthilkumar directed SHRC to respond to the plea in two weeks.
“The only issue is denial of opportunity to the petitioner. We might remit the complaint back to the commission,” the bench said.
According to the petitioner, a DMK member named R Naresh caused unrest during the polling of the local body election in 2022 in several booths in the city.
He was caught red-handed and was handed over to police.However, based on a false complaint made by Naresh, Tondiarpet police registered an FIR against the petitioner under various provisions of the IPC and arrested him on Feb 21, 2022 around 8pm without giving any prior notice, counsel for the petitioner said. Alleging that police had violated his human rights by not providing basic amenities and first-class jail as ordered by the jurisdictional magistrate, the petitioner filed a complaint before SHRC.
On July 7, SHRC closed the complaint without providing any relief sought for by the petitioner.
Now, alleging that the commission has mechanically closed his complaint without providing adequate opportunity to the petitioner he has moved the present appeal in the high court.
