Prayagraj: The Allahabad high court on Friday imposed a cost of Rs 5 lakh in each of three cases against a female teaching faculty of Allahabad University for filing frivolous FIR under SC/ST Act against three senior professors of University. The court also quashed the FIR filed by the female faculty.
Allowing three separate petitions filed by professors Manmohan Krishna, Prahlad Kumar and Javed Akhtar of the Allahabad University (AU), Justice Prashant Kumar observed, “This is a case of pure abuse of process of law where the complainant, just to wreak personal vengeance against a head of department to implicate him and his colleagues by filing false and frivolous cases.” “Whenever the seniors/head of department/professors asked her to teach properly or to take classes regularly, she would file a complaint against them and this is not the first case.The complainant, a well-educated lady, knows the provisions of law very well and had been abusing them for personal gain,” added the court.
While imposing an exemplary cost of Rs 5 lakh in each case, the court said, “Because of filing of frivolous case, reputation and public image of the applicant and his colleagues, who are professors and people with high morals and reputation, was tarnished. They had to run from police station to the court to save themselves.”
On August 4, 2016, FIR was lodged in a local police station by woman assistant professor of economics department of Allahabad University, who alleged that she was insulted and harassed by three professors who used words to humiliate her because of her caste while scolding her. Police submitted a charge sheet in the case, after which the court issued summons against the professors, which were challenged before the high court.
