Commission raps mobile company for selling defective handset to student | Hubballi News – Times of India

Dharwad: The District Consumer Grievances Redressal Commission has rapped a mobile company for selling a defective handset to a customer and has asked the company to replace the defective mobile with a new iPhone within one month of passing the order.
Karthik Yaligar, a student from Mahendrakar Chawl in Dharwad had ordered an iPhone from Apple on Sept 22, 2022, through Flipkart.Karthik had paid Rs 54,019 for the handset and received it on September 25, 2022.
However, the very next day, the handset stopped functioning. The customer immediately contacted Flipkart and Apple company. Based on the advice from the company representatives, Karthik took his handset to a service station in Hubballi. It was found that the iPhone was defective and he was asked to reach out to the Bengaluru service station.
After examining the handset, Karthik was told that the handset was defective. However, they refused to replace the iPhone, claiming that the handset had some external damages and hence could not be covered in the warranty.
Upset with this reply, Karthik tried contacting company heads but did not get any positive response.
Finally, he approached the District Consumer Grievance Redressal Commission and filed a complaint against the company for selling a defective handset.
Admitting the complaint, Commission, headed by retd judge Eshappa Bhute, observed that the handset became defective within one day and not replacing it with a new handset amounts to a lapse in services. The Commission ordered Apple company to replace the defective iPhone with a new handset within one month of passing the order failing which the company had to pay Rs 54,019 with 8% interest rate from the day of passing the order.
The Commission also ordered the company to pay a compensation of Rs 25,000 to the customer for causing mental agony and inconvenience and Rs 10,000 as case expense.
