Ahmedabad: A consumer commission in Gandhinagar has imposed a fine of Rs 10,000 on a company for suing a five-star hotel and demanding full refund for not serving mohanthal and basundi during a wedding anniversary celebration event.
The case involved The Leela and Nishan Multitrade Pvt Ltd, a company dealing in PVC, which held an event at the hotel to celebrate the 50th wedding anniversary of its office-bearers in May.
The hotel was paid Rs 6.44 lakh for 210 guests. However, later the company complained that the hotel did not serve mohanthal and basundi and instead served blueberry cheesecake to its guests. The hotel regretted this and offered a refund of Rs 10,000.
Alleging deficiency in service, the company claimed a full refund in a complaint filed against the hotel and its management, Schloss HMA Pvt Ltd, before the Gandhinagar District Consumer Dispute Redressal Commission.
The hotel management rebutted the charge of deficiency in service and submitted that its services were commended and applauded on the day of the event. The complaint was an afterthought and frivolous litigation.
It supplied the menu that was agreed upon by the complainant, and basundi and mohanthal were not part of the long list of items.
After hearing the case, the commission said that the complainant could not explain the demand for refund of the entire money from the hotel for not serving two sweets. The complainant immediately changed the prayer.
However, the commission did not allow this, and termed the complaint as not maintainable.
It said the hotel is not required to refund even Rs 10,000 because there is no deficiency in service, but the complainant appears to have been ill-advised only to extract money from the hotel.
The commission expressed pain at the “unfounded, misconceived and cryptic nature” of litigation, and imposed a fine on the company.
It directed that Rs 5,000 of the fine amount be given to the hotel, and the rest of the amount be deposited with the consumer welfare fund.

Fire at Juhu hotel, no one injured
A fire broke out at Juhu Residency Hotel in Mumbai, located at Juhu Tara Road. The blaze was confined to the third and fourth floor of the structure. BMC, along with four fire engines, three jumbo water tankers, one turn table ladder, one breathing apparatus van, and an ambulance, rushed to the site. The fire was extinguished by 6.20pm, and fortunately, no injuries were reported.
