Ahmedabad: A city sessions court has denied anticipatory bail to a man whose wife has accused him of raping and molesting her when she was a minor. The woman also stated that the man claimed to be a Kashmiri Pandit but she suspected that he was a Muslim and left his house.
An FIR was lodged with Vasna police last month against one Uttam Kumar Sharma, who was accused by his wife of raping, molesting and threatening her during their two-year relationship, when she was a minor. She alleged that after their wedding, she found out that he was not a Hindu Pandit as he had said but suspected that he was a Muslim after finding that he was circumcised. He was booked under Sections 376, 354, 506 of IPC and under provisions of the Protection of Children from Sexual Offences Act (Pocso).
The complainant said she is unsure about his religious identity, but as she suspected that he was of another religion she left his house in four hours on October 27 and returned to her paternal home. She alleged that Sharma had assumed a false religious identity and perhaps a false name as well, to dupe her.
In his anticipatory bail application, Sharma stated that he married the complainant in September 2023 according to Hindu rituals, and they then got their marriage registered on October 27, 2023. They then went to his house, but his wife’s family members soon arrived and forcibly took her away. Later, Vasna police called him and forced him to divorce her, he alleged.
Public prosecutor Sudhir Brahmbhatt opposed the anticipatory bail application and said that the man has been accused by other women of duping them by assuming a false religious identity as well. The accused has been absconding since the registration of the FIR.
Additional sessions judge J M Brahmbhatt rejected the anticipatory bail plea considering the gravity of charges, with the observation that if he remains free, he could hamper the investigation.
