Ahmedabad: The Gujarat high court on Friday issued notice to the state govt over a petition filed by a woman demanding the registration of an FIR and an independent probe into the custodial death of her husband, which police claimed was suicide by poison.
Amisha Panchal filed the petition stating that her husband, Dipak (45), had been summoned to Navrangpura police station on Jan 5, where he died in suspicious circumstances.While the police claimed he took his own life by ingesting poison, she suspected that he was tortured. After the death, she immediately demanded an investigation.
Before the HC, her advocates submitted that a representation was made on Jan 6 to the city police commissioner demanding an independent probe into the death. However, she heard nothing from the police about any developments in the investigation of the custodial death.
The widow urged the HC to direct police to register an FIR for the custodial death case and constitute a special investigation team (SIT) to probe it, as any involvement of Navrangpura police will defeat the purpose of the investigation.
After a preliminary hearing, Justice H D Suthar sought a reply from the state govt by Feb 15. Till then, the court has directed the government to submit a report showing what progress has been made by the police authorities concerned on the petitioner’s representation made on Jan 6 demanding an independent investigation.
Panchal was arrested by the police based on a complaint by the manager of a Navrangpura jewellery showroom, accusing him of cheating them out of Rs 57 lakh. After his death, the cops said he had committed suicide by ingesting poison.
